Deal with a vehicle in Indiana

You need to continue regular car payments, maintain vehicle registration, and then transfer the car's ownership. You cannot drive the car unless you have proper registration, and penalties will be charged if this is not done on time.

1) If the decedent is the sole owner of the vehicle and a Resident of Indiana, ONE of the following documents is needed to complete the transaction: 

  • A copy of the letters of administration, letters of testamentary, or letters of guardianship

    1. The person with executor powers must sign the title on behalf of the deceased in the same manner as if the deceased were selling the vehicle. The decedent's name must be signed, followed by the name and title of the person executing the document

    2. The letters of administration, letters of testamentary, or guardianship papers must accompany the title

    3. In this situation, a death certificate is not required

  • A court order granting the personal representative of a supervised or unsupervised administration of the estate the authority to transfer the motor vehicle title

    1. The personal representative must sign the title on behalf of the deceased in the same manner as if the deceased were selling the vehicle. The decedent's name must be signed, followed by the name and title of the person executing the document

    2. The court order must accompany the title

    3. In this situation, a death certificate is not required

  • A court order made on a petition for no administration. This is the standard court order that simply tells the BMV to issue title in the name mentioned in the order

    1. Except for the actual order, no other documents are required

    2. As with any court order, the vehicle must be described by vehicle year, make, and VIN (unless a title accompanies the transaction) 

  • An affidavit of no administration on a form designated by the commissioner and a death certificate. This affidavit can be found at https://forms.in.gov/Download.aspx?id=4795. It is commonly called a TM-123 form.

    1. After waiting five days, the TM-123 may be used (along with an original certificate of death) to transfer title to a vehicle

    2. It must be an original death certificate (the branch will make a copy and return the original)

    3. NOTE: The value of the gross probate estate, wherever located, less liens or encumbrances, cannot exceed $50,000. If the estate is valued over $50,000, it must be probated (the will proven genuine and valid) by the court. The applicant will need the court-appointed executor papers

2) Individuals applying for a title will be required to provide two proofs of residency as part of the title application process

  • In most cases, it will be a copy of that person's driver's license or identification card

  • However, any of the documents listed on the BMV Identification List (http://www.in.gov/bmv/2770.htm) may be used for proof of Indiana Residency
