Deal with a vehicle in Mississippi

You need to continue regular car payments, maintain vehicle registration, and then transfer the car's ownership. You cannot drive the car unless you have proper registration, and penalties will be charged if this is not done on time.

Follow these instructions based on your specific situation and relationship to the deceased:

1) Fill out the right forms

  • If there is a will:

    • The person inheriting the vehicle must complete Form 78-006 at the Mississippi tax collector’s office

  • If the title is jointly owned:

    • If the title lists ownership as “John OR Jane Doe,” the surviving partner needs to sign the title

    • If the title lists ownership as “John AND Jane Doe” or “John AND/OR Jane Doe,” the surviving partner needs to sign the total and you need to bring a court-validated copy of the will

  • If the car owner died without a will:

    • The inheritor needs to complete the Affidavit-Owner Dies Without writing a Will form 78-014
