Deal with a vehicle in Florida

You need to continue making regular car payments, maintain vehicle registration, and then transfer the car's ownership. You cannot drive the car unless you have proper registration, and penalties will be charged if this is not done on time.

1) Gather:

  • Original title

  • Certified copy of the death certificate

  • Proof of identity (driver’s license/ID card/passport)

  • If decedent’s name was on the title alone: original or certified copy of the will

  • For surviving spouse: completed HSMV 82152: https://www.flhsmv.gov/pdf/forms/82152.pdf

  • For heirs: completed HSMV 82040: https://flhsmv.gov/dmv/forms/BTR/82040.pdf

  • Payment of title transfer and registration fees

    1. Title transfer fee: $72.25 for electronic title; $2.50 additional fee for paper title

    2. Note that replacement title fees are exempt for surviving spouse

    3. Expedited title fee: $10 (receive title the same day)
